Mike Lee’s Energy Efficiency Reform Act of 2026 (S.5338, introduced Aug. 6; still referred to Senate ENR) would, on enactment, nullify DOE’s Dec. 18, 2023 consumer furnace standard (88 FR 87502) and Oct. 6, 2023 commercial water-heating equipment standard (88 FR 69686). It also directs DOE to finalize the July 7, 2026 Process Rule NPRM within 270 days, drops the six-year lookback, tightens product-class and petition bars, and expands EPCA preemption over state fuel-source / emissions install bans. Not law — track markup and floor action; Issue 3’s CWH enforcement pause sits on a different track.
DOE/EPA finalize ENERGY STAR transition plan — DOE lead within 12 months (3 minute read)
EPA and DOE finalized an Aug. 28, 2026 Transition Plan under their March 3 MOA making DOE the lead agency for ENERGY STAR within twelve months of plan finalization. Three workstreams: knowledge/program leadership transfer; legal transfer of trademarks and foreign agreements (Trademark and Agreement Transfer Plan targeted by Sep. 1, 2026); IT/data hosting migration targeted before July 2027. Plan cites ~1,500 manufacturers, 1,200 retailers, and 840 utilities depending on continuity. Specifiers and OEMs should watch Partner notices and Portfolio Manager / certification handoffs — not a product-spec rewrite.
